This document informs participants about the potential risks associated with using the AlpenStorage Bike Rental Service, available nationwide, and outlines the terms under which the service is offered. This agreement adheres to Virginia law where applicable and seeks to ensure participants acknowledge and accept the inherent risks as part of their voluntary involvement. As lawful consideration for being permitted to use the services, Participants, on behalf of themselves and any accompanying minor Participants, agree to all terms and conditions set forth in this agreement (this “Agreement”).
All riders must wear a helmet while riding a bike as part of the AlpenStorage Bike Rental Service. This requirement is aimed at enhancing safety and reducing the risk of head injuries in the event of an accident. Participants are responsible for providing their own helmets, and the effectiveness of the helmet in preventing injury is not guaranteed by the Service.
The AlpenStorage Bike Rental Service collects personal information, such as contact details, location information, and payment details, to facilitate the provision of services. Location data is gathered to enable app functionality, such as locating available bikes, determining nearby return points, and ensuring proper service operations.
We use third-party payment providers to process payments securely. These providers adhere to strict security standards to protect your financial information. AlpenStorage does not store complete payment card details on its servers.
Additionally, we use third-party analytics tools to improve our services by analyzing app usage patterns and performance. These tools may collect anonymized data to provide insights that help us enhance the user experience.

Participants may cancel their service subscription at any time. Refunds, if applicable, will be provided according to the terms specified at the time of subscription or rental agreement.
Any disputes arising under these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This arbitration will take place in Charlottesville, Virginia, and will be governed by Virginia law, except in cases where federal arbitration law applies.
Participants shall defend, indemnify, and hold harmless AlpenStorage Bike Rental Service, Omni Charlottesville Virginia Corporation, Omni Hotels Management Corporation, and their respective employees, agents, and representatives (collectively, the “Releasees”) against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees and the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers, incurred by the Releasees, arising out of or resulting from Participants’ use of the services, including any violations of these terms and conditions.
The AlpenStorage Bike Rental Service reserves the right to modify these terms and conditions at any time. Changes will become effective immediately upon posting on the service’s website. Continued use of the service after such changes will constitute acceptance of the new terms and conditions.
Although these terms and conditions are applicable nationwide, it is recognized that, in Virginia, pre-injury liability waivers cannot absolve service providers from negligence. This agreement does not attempt to waive such claims against public policy in Virginia or any other state but emphasizes the importance of participants being fully informed about and willingly assuming the risks associated with bicycling.
Engaging with the AlpenStorage Bike Rental Service indicates the participant's acknowledgment of these terms and conditions, understanding of the associated risks, and their decision to participate voluntarily, accepting full responsibility for their safety and conduct.
PARTICIPANTS ARE AWARE AND UNDERSTAND THAT THE SERVICES ARE DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH AND/OR PROPERTY DAMAGE. PARTICIPANTS ACKNOWLEDGE THAT PARTICIPANTS ARE VOLUNTARILY PARTICIPATING IN THE SERVICES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY RELEASEE’S NEGLIGENCE OR GROSS NEGLIGENCE OR OTHERWISE.
Participants hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against Releasees, arising out of or attributable to Participants’ participation in the services, whether arising out of the negligence or gross negligence of any Releasees or otherwise. Participants covenant not to make or bring any such claim against any Releasees, and forever release and discharge Releasees from liability under such claims.
